<p>With a Ph.D. in Population Dynamics and years of experience working in the field of ecology, our client had suitable qualifications to file the first part of the green card process (I-140 petition) under <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> (<a href="http://www.wegreened.com/niw/" title="">National Interest Waiver</a>). <a href="http://www.wegreened.com" title="">North America Immigration Law Group</a> was tasked with putting together a strong <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition packet to convince the USCIS that our client deserved to get one step closer to permanent residency.</p>
<p>In preparing the <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition, we detailed the 189 citations amassed from our client’s 27 publications. We also demonstrated that only a scant handful of researchers with similar qualifications can mirror our client’s research accomplishments. Furthermore, we established that our client’s work on environmental resource management is very important to the United States, especially its pecan and timber industries, and also to the country’s overall water, food and energy production. We left little room for doubt that our client is a national asset, and that halting his work in the country would be detrimental to the nation.</p>
<p>Although we had enough information to present a strong case to the USCIS, we wanted to be sure that we presented an airtight one. Thus, we prompted our client to touch base with other influential experts in his field of ecology. We asked him to persuade these experts to furnish us with recommendation letters attesting to the value of his work to not just his peers, but to the United States as a whole. To our delight, our client returned with four signed letters, all of which firmly supported his <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition. One of these letters stated that <em>“It is patently obvious, considering the originality of his work and his background of achievement, that [Client] has a truly unsurpassed level of ability in ecological research.” </em>Another recommender wrote, <em>“Through his work aiding in the control of the most prominent pest in the pecan industry, [Client] has pushed the field of ecology forward into new arenas of progress. I have no doubt that his work will continue to have extraordinary impacts on ecology, making original contributions to the United States research community that ameliorate and improve industries across the board.”      </em></p>
<p>Nearly 4.5 months after we submitted the well-prepared <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition packet to the USCIS on our client’s behalf, we received an approval notice. We are pleased that the combination of our client’s strong credentials and our diligent efforts paved the way for case approval. We join our client as he celebrates this momentous occasion, and we wish him well as he continues to progress his field of ecology.</p>

<p><strong>Case Summary:</strong></p>
<p>A prominent transmission planning engineer engaged the legal services of <a href="http://www.wegreened.com" title="">North America Immigration Law Group</a> (<a href="http://www.wegreened.com" title="">WeGreened.com</a>) for help with his I-140 petition (first step in the green card process). After thoroughly going through his credentials, we verified that the best course of action to get a green card would be to file his I-140 petition under <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> (<a href="http://www.wegreened.com/niw/" title="">National Interest Waiver</a>). As soon as an attorney-client relationship arose, we immediately set out to prove to the USCIS that our client’s research is important to the United States and that not many other researchers can mirror his success.</p>
<p><strong>Steps Leading Up to Petition Approval:</strong></p>
<p>As strong as our client’s credentials were, and as skilled as our legal team was at putting together successful <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> petitions, it did not change the fact that gaining petition approval was a challenging task. We started off by asking our client to gather recommendation letters from other power systems engineers in his field. The handful of letters that he managed to obtain were strong and certainly served their purpose of proving to the USCIS that our client’s work positively impacts the nation. For instance, one of the letters stated that: <em>“[Client&#8217;s] investigations are of paramount importance to a number of industries in the United States, from electrical energy companies to financial sectors to national security.”</em></p>
<p>These recommendation letters were accompanied by summaries of our client’s portfolio: his citation count, publication record, and research projects. When we filed the case, our client’s work on power system stability had amassed 117 citations, and he had published 9 journal articles and 2 conference publications. He had also conducted more than a dozen peer reviews for various scientific journals. We used these accomplishments and other evidence that we had collected to firmly establish that our client’s investigations are essential to the United States’ efforts to increase energy independence and minimize the national costs associated with large-scale power outages.</p>

<p>The USCIS spent 4 months and 2 days reviewing this <a href="http://www.wegreened.com/niw/" title="">NIW</a> case before granting their approval. <p>With a Ph.D. in Forest Biomaterials and extensive experience in the field of biomaterials, our client had the necessary credentials to file his I-140 petition under the <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> (<a href="http://www.wegreened.com/niw/" title="">National Interest Waiver</a>) visa category. <a href="http://www.wegreened.com" title="">North America Immigration Law Group</a> (Wegreened.com) was contracted to put together a convincing <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition packet and submit it to the USCIS on our client’s behalf.</p>
<p><strong>Our Role in the Process:</strong></p>
<p>As part of our services, we helped our client narrow down a list of potential recommenders whom he could approach for testimonials. Our only criteria were that these recommenders be experts in the field of biomaterials, and that they be familiar with/have used our client’s research findings to progress their own work. Our client managed to obtain four recommendation letters, all of which spoke highly of his research and its value to the United States. One of these experts stated that <em>“… he is one of the finest biomass experts to seek entry in the U.S. and as such facilitates environmental recovery and fuel independency unlike any other similarly qualified scientist.”</em> These letters served as evidence that our client is an asset to the country and that not many other researchers with similar skillsets can mirror his success. These recommendation letters were accompanied by detailed explanations of our client’s various professional accomplishments. For instance, we documented his 10 published papers and the 306 citations gathered from his research. We used these figures to demonstrate to the USCIS that our client’s work is depended upon by other researchers who are also progressing the field.</p>

<p>We recently found out that our client’s I-485 application (last step in the green card process) had also been approved, and we join him as he celebrates becoming an American permanent resident. We noted everything from our client’s Ph.D. in Electrical Engineering to his current research on the interaction between the magnetic field and plasma flow in astronomical structures. We also proved that our client’s work is important to the United States, particularly when it comes to the country’s development of thermonuclear technology and advancement of fusion research. Here are the several stages that we went through before emerging victorious on the other side with an approval notice from the USCIS.</p>

<li><strong>Evaluation: </strong>Before initiating the attorney-client relationship, we carefully evaluated our client’s credentials to establish if he qualified for a green card. Once we determined that he possessed the necessary credentials, we conducted further evaluations to determine which visa category to file his I-140 petition under. <li><strong>Gathering Recommendation Letters: </strong>Once our client had signed and returned the contract to us, we helped him narrow down a list of potential recommenders who could provide us with strong testimonials. We made sure that the elected recommenders were influential experts in our client’s field of physical chemistry. The six recommenders whom we selected all agreed to lend their support, and the recommendation letters that they signed off on were incorporated into our well-balanced <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition packet. These letters furnished the USCIS with proof that our client’s work on gas phase chemical dynamics and spectroscopy is of great importance to the United States.</li>

<li><strong>Compiling Evidence: </strong>As with any legal case, we had to ensure that we had sufficient proof to argue our stand that our client deserved to get one step closer to permanent residency. We used Google Scholar to determine the total number of citations to our client’s work (37 citations) and established that he had published a dozen scientific papers. We used these figures, along with additional evidence that we had gathered, to convince the USCIS that our client’s investigations contribute to the American combustion industry, specifically in terms of furthering the nation’s understanding of various environments, such as those found in soot-forming processes. Our <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition also included a copy of our client’s Ph.D. in Chemistry and its corresponding transcripts—to prove that he is equipped with the theoretical knowledge and skills to conduct outstanding research.</li>

<li><strong>Refining and Submitting the Petition: </strong>After several months of carefully compiling everything we needed to present a strong case to the USCIS, we prepared a well-worded petition letter to summarize all of our findings. We then submitted the comprehensive <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition packet on our client’s behalf and waited for a verdict from Texas Service Center. As is clear from the publication of this success story, they approved our petition.</li>

<li><strong>Value of Work: </strong>Using Google Scholar and similar references, we established that our client’s work had earned 89 citations and that he had published half a dozen journal articles, 1 monograph, 1 book chapter, and numerous conference papers. We also noted the 17 times he conducted peer reviews for scientific journals and conferences. Not only did we demonstrate the value of our client’s research findings to other researchers in the field of control systems engineering, we also demonstrated the value of his work to the United States as a whole, particularly the country’s space exploration efforts, military, healthcare, and transportation technologies.</li>
<li><strong>Research Topics: </strong>We carefully reviewed and outlined our client’s development of control systems for use in autonomous vehicles. By understanding the core of our client’s research, we were able to argue its significance to the research community as well as to the United States. We also convinced the USCIS that only a handful of other researchers can attain such meritorious research results.</li>
<li><strong>Support from Peers: </strong>Third-party support played a crucial role in our presentation. We started off by helping our client narrow down a list of possible recommenders who could attest to the usefulness of his work. We then urged our client to contact these people—all of whom are experts in the field—and request for recommendation letters. Our client obtained five letters, one of which described his work as <em>“… truly impressive.”</em> Another recommender stated that <em>“ […] [T]he ongoing nature of space exploration, environmental modeling, unmanned surveillance, and the heightened risks posed by climate change, international terrorism, and so forth, make [Client’s] work imperative to this country for many years to come.”</em></li>

<p>Our presentation of our client’s strong credentials and significance of his work to the United States persuaded the USCIS to approve his <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition. We are extremely pleased at the outcome and would like to congratulate our client for overcoming such a significant hurdle. We now shift our attention towards the final step of the green card process. As our client chose to file I-485 applications for himself and his wife while his <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition was pending approval, we estimate that the USCIS should make a decision on their I-485s soon. Once those are approved, our client and his wife will become permanent residents. We join them as they await optimistic news.</p>

<p>This <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> (<a href="http://www.wegreened.com/niw/" title="">National Interest Waiver</a>) case involved a gifted graduate research assistant from Taiwan working in the field of photovoltaics. One of these experts wrote, <em>“With this work and her related studies, [Client] is clearing the way for a large-scale shift to solar energy, thus reducing the United States’ dependence on imported fossil fuels and the environmental degradation that is associated with their use. I can think of few lines of research with as much to offer the United States, and [Client] is emblematic of the talent we need to attract to make this future a reality.”</em> These letters served as proof that our client’s insights are essential to the field.</p>
<p><strong>Demonstration of capabilities:</strong></p>
<p>Our legal team amassed a wealth of information on our client’s many professional accomplishments and included them in our well-worded <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition packet. We documented our client’s M.Sc. in Engineering, the 63 citations gathered from her 2 journals papers and 2 conference proceeding articles, and carefully detailed her research on developing and optimizing novel solar cell systems for harvesting solar energy. We then used this information to prove to the USCIS that our client’s research efforts are contributing to the United States’ energy independence and environmental health.</p>
<p><strong>In conclusion:</strong></p>
<p>Thanks to our client’s strong credentials and our legal team’s diligent efforts, the immigration officers at TSC only spent 37 days adjudicating this case.
