Case Summary:

Largely due to Premium Processing, Nebraska Service Center only spent five days reviewing our client’s EB-1A (Alien of Extraordinary Ability) petition. By paying the USCIS an additional $1,225, our client enjoyed rapid adjudication (within 15 days instead of 4-9 months) and can now file an I-485 application whenever she wants.

North America Immigration Law Group (WeGreened.com) is pleased that our client obtained an EB-1A approval: it verifies our expertise in putting together strong petition packets to help our clients get one step closer to their green cards. Here are some of the key points that this client’s petition contained:

Qualifications: Before approving an I-140 petition, the USCIS must first be convinced that the petitioner has made a significant impact in his or her field. In this case, we listed our client’s various achievements: her 18 publications, the 1220 citations to her work, and the 38 times she carried out peer reviews for 14 prominent scientific journals. We used these figures to highlight the impact that her investigations have on other researchers, namely that her findings significantly advance their work in the field of plant biology.

Research Results: The many years that our client spent working in the field has honed her skills in researching the utilization of comparative, computational, and experimental genomic models to examine the underlying structural and functional genomic changes in various plant crops. We reviewed our client’s research projects to better understand their advantages to the nation, and demonstrated to the USCIS that they benefit the United States agricultural industry by improving agricultural yields and disease resistance in many nationally-relevant crops.

Recommendations: One of the most important elements of our client’s EB-1A petition contained her five recommendation letters. These letters were obtained from experts in her field who were willing to attest to the value of her work. One of our client’s recommenders—a leading professor in the field—stated that her work has “… tremendous significance for research communities in the United States and abroad.” He also stated that “… [Client] approaches her research with inventive methodologies and her work has already proven instrumental in shaping research tendencies in the field. Her continued and active involvement in scientific investigation is critical to the sustained progression of our understanding of plant genome evolutionary biology. [Client’s] diligent production of cutting-edge research has granted her an indisputable position at the forefront of this field.”

We would like to congratulate our client for getting one step closer to permanent residency. We wish her well with her I-485 application (final step in green card proceedings) and look forward to receiving an update from her once the USCIS makes a decision on her application.

Approval Notice Date: March 14th, 2016

Processing Time: 10 months

Case Summary:

Exactly 10 months after we filed an EB-1A (Alien of Extraordinary Ability) petition on our client’s behalf, we received an approval notice from Texas Service Center (TSC). Our client, a postdoctoral researcher immersed in the field of biomedical science, hired North America Immigration Law Group (WeGreened.com) to organize and submit a strong EB-1A petition for him. We worked diligently to consolidate as much relevant information as we could on our client’s diverse portfolio.

Outstanding Credentials:

As EB-1A has a very high standard of law, we needed to convince the USCIS that our client’s credentials were legitimate and that his work positively impacts the United States. We started by documenting his citation and publication record, which at the time of filing stood at 1204 citations and 7 publications. We also listed the nearly two dozen times he conducted peer reviews for journals and conferences. We used this information to demonstrate to the USCIS that our client’s work is highly regarded by other researchers in his field and that it is used to advance the work of other biomedical scientists.

We also detailed our client’s research efforts on the development of novel scientific technologies regarding nanoparticle drug delivery and bioengineering. We established that his findings boost the American pharmaceutical industry and significantly progress the fields of nanotechnology and microfluidic engineering. We supported our claims by incorporating recommendation letters into our EB-1A petition packet. Our client gathered these letters from other leaders in his field, all of whom willingly authenticated the evidence included in our presentation. One of our client’s supporters wrote, “His presence in the United States is invaluable for the development of superior medical treatments for diseases like GTS, although his work also has palpable applications for anti-cancer therapy, as well.” Another supporter described our client’s work as “… highly beneficial to the scientific community in the United States and globally.”

Filing an I-485:

Our client chose to file I-485 applications (final step in the green card process) for himself and his spouse while his EB1A petition was pending approval. We hope that they receive news on their applications soon. Meanwhile, we would like to thank our client for selecting our firm to help him attain permanent residency, and we wish him well as he continues to advance his field of biomedical science.

Case Summary:

Not long ago, North America Immigration Law Group (WeGreened.com) helped a postdoctoral associate from China file an EB-1A (Alien of Extraordinary Ability) petition on his behalf. Our client’s extensive experience in the field of textile engineering has resulted in various publications, an impressive citation count, and other professional triumphs. We were tasked with compiling these accomplishments into a well-balanced EB-1A petition packet for our client, which we did efficiently and effectively. Part of the petition was composed of the following:

Publication & Citation Record: When we filed the case, our client’s research in the field of textile engineering had amassed nearly 500 citations. Additionally, his investigations had produced 30 scientific articles, 8 conference abstracts, 1 book chapter, and 2 patents.

Peer Review History: Our client has conducted a staggering 51 peer reviews for a variety of prominent scientific publications. As high impact journals only invite leaders in the field to judge the work of others, this impressive record clearly demonstrates the value of our client’s work to other researchers.

Strong Advocacy: We needed as much support as we could get to ensure that our EB-1A petition was bulletproof. We counseled our client to reach out to other expert engineers and request for recommendation letters. To our delight, five experts agreed to help. Their letters were exactly what we needed to bolster our EB-1A petition packet. One of our client’s recommenders described his work as “…unquestionably important. Not only do the fiber and textile markets cover a significant share of the global manufacturing economy, but well- designed materials are also necessary for the safety of military personnel, those exposed to dangerous environmental conditions, and industrial workers, to name a few examples. [Client’s] textile engineering research is therefore a very valuable pursuit, and should be supported to the upmost degree.”

We are pleased that our diligent efforts and our client’s outstanding credentials convinced the USCIS to approve this EB-1A petition. This approval notice is yet another encouraging example of North America Immigration Law Group’s dedication to helping every client get as close as they want us to bring them to a green card.

Case Summary

With multiple years of experience working in the field of plant sciences, our client—a postdoctoral researcher from India—seemed to be a suitable candidate for EB-1A (Alien of Extraordinary Ability). Before initiating the contract, we conducted a thorough evaluation of his credentials to be absolutely certain, and as it turns out, we were right.

EB-1A Petition:

It is no secret that EB1A is upheld by a high standard of law and that not many petitioners qualify for this visa category. Thus, in order to convince the USCIS to approve our client’s EB-1A petition, we needed to be extremely meticulous in our presentation of his various accomplishments. We could not leave any stone unturned, and we had to thoroughly prove that our client’s presence in the United States would continue benefitting the country. Here are some of the key points that we presented to the USCIS:

Research Projects: Our client’s work in the field of plant sciences focuses on the role of microbes in rice cultivation, and, more broadly, on crop protection and improvement. His work advances our understanding of how to increase the health and yield levels of important commercial crops. We reviewed our client’s investigations and proved to the USCIS that his findings are extremely beneficial to the U.S. agricultural sector.

Proof of Utilization: By detailing our client’s 18 journal articles, two books, the 147 citations to his work, and the 20 times he conducted peer reviews for well-known journals, we proved that his opinions are highly sought after and utilized by other scientists to progress their research.

Strong Support: We understood the significance of unbiased third-party support, and urged our client to contact other experts in his field of plant science. We needed him to request them to contribute recommendation letters that stated the importance of his work to the field, as well as to the country. Six experts agreed to lend their support, one of whom stated that “I would like to reiterate the high value of [Client’s] research and its uniquely essential nature. As a highly accomplished scientist residing at the pinnacle of his field, he has time and again made contributions of inestimable value to the field. It would be a tragic loss, both to the plant sciences/molecular biology field and to the scientific community in general, were [Client] to be unable to continue his work in this country. I can state with absolutely certainty and veracity that his work is needed to continue the advancement of our field.”

Thanks to Premium Processing, we received an approval notice merely a week after we filed the EB-1A petition on our client’s behalf. We would like to congratulate our client on this milestone. Approximately a month ago, we helped him and his spouse file their I-485 applications. This is the final step in the green card process and once the USCIS approves their applications, they will receive their green cards. We join them as they await a positive outcome from Nebraska Service Center.

A senior research engineer working in the field of aerosol science hired North America Immigration Law Group (WeGreened.com) to put together a convincing EB-1B (Outstanding Professors and Researchers) petition packet on his behalf. As EB1B is an employer-sponsored visa category, our client had to first convince his employer—a private company—to serve as the petitioner. Only once he received his employer’s full support did he sign the contract with us.

EB-1B Petition Dossier:

As with all our cases, we worked diligently to help our client present a strong petition to the USCIS. We started by encouraging our client to contact a list of experts in his field for recommendation letters—we made sure that these experts were familiar with our client’s research and/or had directly worked with him. Our client persuaded six experts to lend their support, all of whom signed off on letters that attested to the value of our client’s research on atmospheric nucleation and aerosol mass measurement to the United States. For instance, one of these experts stated that “The United States benefits greatly from hosting the most innovating and effective minds in any research field, and [Client] is one such elite-level researcher in aerosol science. His proven ability to recalibrate and enhance existing measurement instruments means that he is invaluable to climate change research and technological innovations.” Besides recommendation letters, our EB-1B petition dossier consisted of data on the 239 citations to our client’s work, his 7 publications, and the 11 times he conducted peer reviews for scientific journals.

Despite our meticulously presented EB1B petition, the USCIS took longer than usual to adjudicate it. We raised a service request on our client’s behalf when the average time frame went beyond what we expected. The USCIS responded by saying that our client’s petition was under extended review. Four months after they sent us a reply, they approved the petition.

Final Step towards a Green Card:

Approximately two months after we received an approval notice for our client’s EB-1B petition, we filed an I-485 application on his behalf. This is the final step in the green card process and once approved, our client will receive his green card. We join him as he eagerly awaits a favorable decision from the USCIS..

Case Summary:

A postdoctoral fellow from China hired North America Immigration Law Group (WeGreened.com) to file an EB-1A (Alien of Extraordinary Ability) petition on his behalf. Once we had compiled everything we needed, we submitted the carefully prepared EB-1A petition under Premium Processing.

Premium Processing:

So what exactly is Premium Processing (PP)? It is a paid option offered by the USCIS for certain EB-1, EB-2 and EB-3 visa categories (EB-1A is one of them). By paying an additional $1,225 to the USCIS, petitioners can enjoy rapid adjudication: action will be taken within 15 days whereas petitioners who opt out of/do not qualify for PP have to wait between 4-9 months. Petitioners may elect to file their case under PP either from the get-go, or any time during the adjudication process. In this case, our client initially decided to forgo PP but changed his mind a little over two months later. After the USCIS received our request for PP service (Form I-907) and the associated fee, his case was immediately upgraded to PP. Our client only waited 12 days after the upgrade for an approval notice.

Compelling EB-1A Case:

Although PP was largely responsible for rapid adjudication, we have no doubt that our meticulously prepared petition detailing our client’s impressive credentials paved the way for petition approval. Here are some of the key pieces of information that our petition focused on:

Publication Record: When we filed the case, our client had published 14 peer-reviewed scientific articles, 3 book chapters, and at least 20 conference presentations.

Citation Evidence: Using Google Scholar and other references akin to it, we determined that our client’s work had collected 130 citations when we filed the case.

Peer Review Involvement: Our client had assessed the work of his peers over two dozen times for approximately 10 scientific journals. As journals only invite leading researchers to conduct peer reviews, our client’s outstanding record highlighted the value of his opinions.

Independent and Dependent Support: We prompted our client to reach out to other experts in his field of biology. We needed him to persuade them to furnish us with strong recommendation letters to bolster our EB-1A petition. To our delight, our client returned with six recommendation letters, all of which confirmed the value of his research to the United States; his approaches on early diagnosis and treatment of diseases and disorders, including cancer, diabetes, and inflammation greatly advance the country’s medical sector. One of his recommenders stated that “[Client’s] past achievements, as reflected by his extensive publication and citation record, have been outstanding. It can only be expected that [Client] will continue to be influential in his field and the global community of health science researchers. It is for these reasons that he should be allowed to remain in the United States, where he has access to the best tools to further his research.”

We are pleased that Nebraska Service Center allowed our client to get significantly closer to his green card. Now all he has to do is file I-485 applications for himself and his dependent(s) and once approved, they will become American permanent residents.

Case Summary:

This EB-1B (Outstanding Professors and Researchers) case involved a gifted scientist from India. He hired North America Immigration Law Group to help him file an I-140 petition under EB-1B. Since this is an employer-petitioned visa category, he needed his employer’s full support, which he received. Additionally, his employer—a private company—furnished us with all the information we needed to efficiently file our client’s EB-1B petition.

A main part of our job was to compile as much relevant information as we could on our client’s various professional and scholarly achievements and put together an impressive EB-1B petition dossier. We listed his 3 published scientific papers and the 63 citations gathered from his work. Furthermore, we proved to the USCIS that our client’s research findings are of great value to not just his employer, but to the United States as a whole. We did this by carefully reviewing and accounting for our client’s various research projects on numerically modeling and simulating fluid dynamics processes, such as high-speed combustion in scramjet engines and the aerodyanamics of spacecrafts. We used what we learned to prove to the USCIS that our client’s investigations are contributing to the United States’ spacecraft construction and aeronautical engineering efforts.

In a bid to make our case even stronger, we advised our client to obtain recommendation letters from several other specialists in his field. His perseverance paid off and he returned with six strong testimonials. Here are a couple of excerpts:

“…[Client] has made advancements in how we study and design these engines through numerical computational simulations, which reduce the expenses and time involved in the procedure. There are few with the talent to make such worthwhile discoveries, and so I feel [Client’s] status as a researcher speaks for itself.” – Prominent mechanical and aerospace engineering professor

“[Client] is a rare talent who has leveraged his abilities with numerical simulation to offer breakthroughs in numerical simulation of this technology, so that they can be studied and likewise constructed with a degree of expediency and efficacy not hitherto enjoyed by the field.” – Well-known aerospace engineering assistant professor

A little over four months after we filed our client’s EB-1B petition, he decided that he wanted to upgrade his case to be reviewed under Premium Processing. He received notification of case approval just six days after the upgrade. Our client recently retained our services to help him file an I-485 application. Considering it is the last step towards a green card, our client will become an American permanent resident once it is approved. We join our client as he eagerly awaits a favorable decision from the USCIS. In the meantime, we thank him for selecting our firm to help him attain green card success, and we wish him well as he continues to advance his field of computational fluid dynamics.

Case Summary:

North America Immigration Law Group (WeGreened.com) helped a talented postdoctoral research associate from India file two I-140 petitions: one under the EB-2 NIW (National Interest Waiver) visa category, and the other under EB-1A (Alien of Extraordinary Ability). It is not unusual for our clients to file two petitions at the same time as it increases their chances of getting an approval. In this case, our client’s EB-1A petition was approved whereas his EB-2 NIW petition is still pending approval. We are pleased that our client obtained an EB-1A approval because now, he does not have to wait for his priority date to become current before partaking in the second and final step of the green card process: the I-485 application.

‘Current’ Priority Date:

The USCIS has a strict quota system in place that restricts the number of green cards granted to applicants with EB-2 NIW approvals who were born in certain countries (India is one of them). As our client was born in India, he would have to wait several years for his priority date to become current if he chooses to apply for a green card based on an approved NIW petition. However, seeing that there is no quota in place for the EB-1 visa category, our client may file an I-485 any time he wants with his EB1A approval.

Our Winning EB-1A Petition:

Our job was to compile as much information as we could on our client’s professional accomplishments and put together a strong EB-1A petition packet. Our presentation was composed of our client’s eight publications, the 91 citations to his work, and the 21 times he conducted peer reviews for a number of acclaimed scientific journals. We also detailed his research projects related to heart failure, as well as investigations linked to other aspects of the human body. Based on everything we gathered, our petition packet demonstrated to the USCIS that our client’s work is important to the United States. To bolster our presentation, we incorporated recommendation letters signed by other expert molecular biologists, one of whom firmly stated, “There are few scientists capable of equaling both the sheer volume, and caliber, of [Client’s] career. I am confident in stating that he could not be replaced, and that the field of biochemical research would suffer without his presence.”

In Conclusion:

We would like to congratulate our client for surpassing this significant milestone in the long journey towards a green card. We wish him well with his I-485 application and thank him for choosing our firm to represent his EB-1A and NIW petitions.

Premium Processing:

Largely due to Premium Processing (PP), our client received an EB1A approval notice from the USCIS just six days after we filed the petition on his behalf. By paying the USCIS an extra $1,225, petitioners whose cases are filed under PP get to enjoy speedy processing: within 15 days instead of 4-9 months.

Case Summary:

This EB-1A (Alien of Extraordinary Ability) case involved a prominent postdoctoral fellow immersed in the field of biophysics. Born in China, our client has many years of experience conducting research, and has established a name for himself as one of the top biophysicists in his field.

With a Ph.D. in Biophysics and Computational Biology and various research projects focused on the molecular mechanisms and pathways of membrane transport proteins, our client had the credentials to file his I-140 petition under EB1A, which has a very high standard of law. We worked diligently to put together a strong EB-1A petition packet that highlighted his talents. Our presentation contained the following:

Publication & Citation Record: When we filed the case, our client’s work had gathered 160 citations. Furthermore, he had already published 10 scientific articles and three book chapters.

Encouraging Testimonials: When we first took on our client’s case, we prompted him to touch base with other influential researchers in his field and request for recommendation letters. We needed third-party opinions on the value of our client’s work to the field, and approaching fellow biophysicists was the best way to do it. Our client managed to obtain six recommendation letters, one of which stated, “Overall, these achievements of [Client] are indicative of a researcher who has reached the top of his field and is likely to continue in his path of success. Because of this, he is a great asset to the scientific community of biophysics and computational biology researchers in the United States and therefore he should be permitted to persist in his research efforts.”

Peer Review Experience: The importance of our client’s insights was demonstrated through the 18 peer reviews he conducted for several prominent scientific journals. Judging the work of others is a task reserved for leaders in the field and our client’s extensive experience doing so attests to the value of his opinions to both American and international biophysicists.

Overall, the USCIS only spent 6 days adjudicating our client’s EB-1A petition before granting their approval. The compressed timeline had to do with the fact that our client chose to file his case under Premium Processing (immigration officers must take action on PP cases within 15 days as opposed to 4-9 months for regularly filed petitions). We congratulate our client on receiving an approval notice, and we wish him well as he continues to progress his field of biophysics.

Case Summary:

This EB-1A (Alien of Extraordinary Ability) case involved a postdoctoral fellow immersed in the field of molecular pathology. Our client, who has years of experience conducting research on the molecular mechanisms of chronic inflammatory diseases, had suitable credentials to file his case under this visa category.

We did everything we could to gather as much information as possible on our client’s copious professional exploits. When we were ready to submit our comprehensive EB-1A petition to the USCIS, it contained details on our client’s 15 published papers, his 12 conference articles, the 18 times he conducted peer reviews, and the 137 citations gathered from his work.

In a bid to ensure that our EB-1A presentation was impenetrable, we urged our client to ask other professional molecular pathologists to lend their support. Six experts agreed to contribute recommendation letters that highlighted the value of our client’s research efforts to the United States. According to one of these letters: “In 2004, America spent an estimated $1.84 billion on patients suffering from IBD alone. Though no cure for the disease exists presently, the work that [Client] has done has greatly advanced our understanding of how the disease works and how to properly treat the symptoms. The advancements he has made have extended our understanding of IBD and its treatment in an invaluable way.”

Rapid Adjudication:

Our client’s EB-1A petition was reviewed and approved in 10 days. This was largely due to Premium Processing (PP), an option only available to specific EB-1, EB-2, and EB-3 visa categories. By paying an additional $1,225 to the USCIS, our client enjoyed rapid adjudication (officers have to take action on PP cases within 15 days). We are pleased at the outcome and congratulate our client on obtaining an EB-1A approval. Now all he has to do is file an I-485 application and once that is approved, he will become an official American permanent resident.
