<p>Largely due to Premium Processing, Nebraska Service Center only spent five days reviewing our client’s <a href="http://www.wegreened.com/EB1A" title="">EB-1A</a> (<a href="http://www.wegreened.com/EB1A" title="">Alien of Extraordinary Ability</a>) petition. By paying the USCIS an additional $1,225, our client enjoyed rapid adjudication (within 15 days instead of 4-9 months) and can now file an I-485 application whenever she wants.</p>
<p><a href="http://www.wegreened.com" title="">North America Immigration Law Group</a> (<a href="http://www.wegreened.com" title="">WeGreened.com</a>) is pleased that our client obtained an <a href="http://www.wegreened.com/EB1A" title="">EB-1A</a> approval: it verifies our expertise in putting together strong petition packets to help our clients get one step closer to their green cards. Here are some of the key points that this client’s petition contained:</p>

<li><strong>Qualifications: </strong>Before approving an I-140 petition, the USCIS must first be convinced that the petitioner has made a significant impact in his or her field. In this case, we listed our client’s various achievements: her 18 publications, the 1220 citations to her work, and the 38 times she carried out peer reviews for 14 prominent scientific journals. We used these figures to highlight the impact that her investigations have on other researchers, namely that her findings significantly advance their work in the field of plant biology.</li>
<li><strong>Research Results: </strong>The many years that our client spent working in the field has honed her skills in researching the utilization of comparative, computational, and experimental genomic models to examine the underlying structural and functional genomic changes in various plant crops. We reviewed our client’s research projects to better understand their advantages to the nation, and demonstrated to the USCIS that they benefit the United States agricultural industry by improving agricultural yields and disease resistance in many nationally-relevant crops.</li>
<li><strong>Recommendations: </strong>One of the most important elements of our client’s <a href="http://www.wegreened.com/EB1A" title="">EB-1A</a> petition contained her five recommendation letters. These letters were obtained from experts in her field who were willing to attest to the value of her work. One of our client’s recommenders—a leading professor in the field—stated that her work has <em>“… tremendous significance for research communities in the United States and abroad.” </em>He also stated that <em>“… [Client] approaches her research with inventive methodologies and her work has already proven instrumental in shaping research tendencies in the field. Her continued and active involvement in scientific investigation is critical to the sustained progression of our understanding of plant genome evolutionary biology. [Client’s] diligent production of cutting-edge research has granted her an indisputable position at the forefront of this field.”</em></li>

<p>Exactly 10 months after we filed an <a href="http://www.wegreened.com/EB1A" title="">EB-1A</a> (<a href="http://www.wegreened.com/EB1A" title="">Alien of Extraordinary Ability</a>) petition on our client’s behalf, we received an approval notice from Texas Service Center (TSC). Our client, a postdoctoral researcher immersed in the field of biomedical science, hired <a href="http://www.wegreened.com" title="">North America Immigration Law Group</a> (<a href="http://www.wegreened.com" title="">WeGreened.com</a>) to organize and submit a strong <a href="http://www.wegreened.com/EB1A" title="">EB-1A</a> petition for him. We worked diligently to consolidate as much relevant information as we could on our client’s diverse portfolio.</p>
<p><strong>Outstanding Credentials:</strong></p>
<p>As <a href="http://www.wegreened.com/EB1A" title="">EB-1A</a> has a very high standard of law, we needed to convince the USCIS that our client’s credentials were legitimate and that his work positively impacts the United States. We started by documenting his citation and publication record, which at the time of filing stood at 1204 citations and 7 publications. We also listed the nearly two dozen times he conducted peer reviews for journals and conferences. We used this information to demonstrate to the USCIS that our client’s work is highly regarded by other researchers in his field and that it is used to advance the work of other biomedical scientists.</p>
<p>We also detailed our client’s research efforts on the development of novel scientific technologies regarding nanoparticle drug delivery and bioengineering. We established that his findings boost the American pharmaceutical industry and significantly progress the fields of nanotechnology and microfluidic engineering. We supported our claims by incorporating recommendation letters into our <a href="http://www.wegreened.com/EB1A" title="">EB-1A</a> petition packet. Our client gathered these letters from other leaders in his field, all of whom willingly authenticated the evidence included in our presentation. One of our client’s supporters wrote, “<em>His presence in the United States is invaluable for the development of superior medical treatments for diseases like GTS, although his work also has palpable applications for anti-cancer therapy, as well.”</em> Another supporter described our client’s work as <em>“… highly beneficial to the scientific community in the United States and globally.”</em></p>
<p><strong>Filing an I-485:</strong></p>
<p>Our client chose to file I-485 applications (final step in the green card process) for himself and his spouse while his <a href="http://www.wegreened.com/EB1A" title="">EB1A</a> petition was pending approval. We hope that they receive news on their applications soon. <p>With a Ph.D. in Population Dynamics and years of experience working in the field of ecology, our client had suitable qualifications to file the first part of the green card process (I-140 petition) under <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> (<a href="http://www.wegreened.com/niw/" title="">National Interest Waiver</a>). <a href="http://www.wegreened.com" title="">North America Immigration Law Group</a> was tasked with putting together a strong <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition packet to convince the USCIS that our client deserved to get one step closer to permanent residency.</p>
<p>In preparing the <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition, we detailed the 189 citations amassed from our client’s 27 publications. We also demonstrated that only a scant handful of researchers with similar qualifications can mirror our client’s research accomplishments. Furthermore, we established that our client’s work on environmental resource management is very important to the United States, especially its pecan and timber industries, and also to the country’s overall water, food and energy production. We left little room for doubt that our client is a national asset, and that halting his work in the country would be detrimental to the nation.</p>
<p>Although we had enough information to present a strong case to the USCIS, we wanted to be sure that we presented an airtight one. Thus, we prompted our client to touch base with other influential experts in his field of ecology. We asked him to persuade these experts to furnish us with recommendation letters attesting to the value of his work to not just his peers, but to the United States as a whole. To our delight, our client returned with four signed letters, all of which firmly supported his <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition. One of these letters stated that <em>“It is patently obvious, considering the originality of his work and his background of achievement, that [Client] has a truly unsurpassed level of ability in ecological research.” </em>Another recommender wrote, <em>“Through his work aiding in the control of the most prominent pest in the pecan industry, [Client] has pushed the field of ecology forward into new arenas of progress. I have no doubt that his work will continue to have extraordinary impacts on ecology, making original contributions to the United States research community that ameliorate and improve industries across the board.”      </em></p>
<p>Nearly 4.5 months after we submitted the well-prepared <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition packet to the USCIS on our client’s behalf, we received an approval notice. We are pleased that the combination of our client’s strong credentials and our diligent efforts paved the way for case approval. <p>A prominent transmission planning engineer engaged the legal services of <a href="http://www.wegreened.com" title="">North America Immigration Law Group</a> (<a href="http://www.wegreened.com" title="">WeGreened.com</a>) for help with his I-140 petition (first step in the green card process). After thoroughly going through his credentials, we verified that the best course of action to get a green card would be to file his I-140 petition under <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> (<a href="http://www.wegreened.com/niw/" title="">National Interest Waiver</a>). As soon as an attorney-client relationship arose, we immediately set out to prove to the USCIS that our client’s research is important to the United States and that not many other researchers can mirror his success.</p>
<p><strong>Steps Leading Up to Petition Approval:</strong></p>
<p>As strong as our client’s credentials were, and as skilled as our legal team was at putting together successful <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> petitions, it did not change the fact that gaining petition approval was a challenging task. We started off by asking our client to gather recommendation letters from other power systems engineers in his field. The handful of letters that he managed to obtain were strong and certainly served their purpose of proving to the USCIS that our client’s work positively impacts the nation. For instance, one of the letters stated that: <em>“[Client&#8217;s] investigations are of paramount importance to a number of industries in the United States, from electrical energy companies to financial sectors to national security.”</em></p>
<p>These recommendation letters were accompanied by summaries of our client’s portfolio: his citation count, publication record, and research projects. When we filed the case, our client’s work on power system stability had amassed 117 citations, and he had published 9 journal articles and 2 conference publications. He had also conducted more than a dozen peer reviews for various scientific journals. We used these accomplishments and other evidence that we had collected to firmly establish that our client’s investigations are essential to the United States’ efforts to increase energy independence and minimize the national costs associated with large-scale power outages.</p>
<p><strong>In Conclusion:</strong></p>
<p>The USCIS spent 4 months and 2 days reviewing this <a href="http://www.wegreened.com/niw/" title="">NIW</a> case before granting their approval. We are pleased at the outcome and would like to thank our client for placing his trust in us. Our client chose to file his I-485 application (second and final step in the green card process) by following the clear guidelines in our D.I.Y. Packet. <p><strong>What Does ‘Priority Date’ Mean?</strong></p>
<p>The USCIS has specific quotas in place when approving green cards to applicants born in certain countries. In this case, our client was born in China and holds an <a href="http://www.wegreened.com/niw/" title="">EB-2</a> approval. This restricts her from filing an I-485 application until her priority date becomes current, which is several years from now. Before initiating the contract, we conducted a thorough evaluation of his credentials to be absolutely certain, and as it turns out, we were right.</p>

<li><strong>Strong Support: </strong>We understood the significance of unbiased third-party support, and urged our client to contact other experts in his field of plant science. We needed him to request them to contribute recommendation letters that stated the importance of his work to the field, as well as to the country. Six experts agreed to lend their support, one of whom stated that <em>“I would like to reiterate the high value of [Client’s] research and its uniquely essential nature. As <a href="http://www.wegreened.com/EB1B-Outstanding-Professors-and-Researchers" title="">EB1B</a> is an employer-sponsored visa category, our client had to first convince his employer—a private company—to serve as the petitioner. Only once he received his employer’s full support did he sign the contract with us.</p>

<p>As with all our cases, we worked diligently to help our client present a strong petition to the USCIS. We started by encouraging our client to contact a list of experts in his field for recommendation letters—we made sure that these experts were familiar with our client’s research and/or had directly worked with him. Our client persuaded six experts to lend their support, all of whom signed off on letters that attested to the value of our client’s research on atmospheric nucleation and aerosol mass measurement to the United States. For instance, one of these experts stated that <em>“The United States benefits greatly from hosting the most innovating and effective minds in any research field, and [Client] is one such elite-level researcher in aerosol science. His proven ability to recalibrate and enhance existing measurement instruments means that he is invaluable to climate change research and technological innovations.” </em>Besides recommendation letters, our <a href="http://www.wegreened.com/EB1B-Outstanding-Professors-and-Researchers" title="">EB-1B</a> petition dossier consisted of data on the 239 citations to our client’s work, his 7 publications, and the 11 times he conducted peer reviews for scientific journals.</p>
<p>Despite our meticulously presented <a href="http://www.wegreened.com/EB1B-Outstanding-Professors-and-Researchers" title="">EB1B</a> petition, the USCIS took longer than usual to adjudicate it. We raised a service request on our client’s behalf when the average time frame went beyond what we expected. The USCIS responded by saying that our client’s petition was under extended review. Four months after they sent us a reply, they approved the petition.</p>
<p><strong>Final Step towards a Green Card:</strong></p>

<p><strong>Premium Processing:</strong></p>
<p>So what exactly is Premium Processing (PP)? It is a paid option offered by the USCIS for certain <a href="http://www.wegreened.com/EB1A" title="">EB-1</a>, <a href="http://www.wegreened.com/niw/" title="">EB-2</a> and EB-3 visa categories (<a href="http://www.wegreened.com/EB1A" title="">EB-1A</a> is one of them). By paying an additional $1,225 to the USCIS, petitioners can enjoy rapid adjudication: action will be taken within 15 days whereas petitioners who opt out of/do not qualify for PP have to wait between 4-9 months. Petitioners may elect to file their case under PP either from the get-go, or any time during the adjudication process. In this case, our client initially decided to forgo PP but changed his mind a little over two months later. After the USCIS received our request for PP service (Form I-907) and the associated fee, his case was immediately upgraded to PP. Our client only waited 12 days after the upgrade for an approval notice.</p>
<p><strong>Compelling <a href="http://www.wegreened.com/EB1A" title="">EB-1A</a> Case:</strong></p>
<p>Although PP was largely responsible for rapid adjudication, we have no doubt that our meticulously prepared petition detailing our client’s impressive credentials paved the way for petition approval. Here are some of the key pieces of information that our petition focused on:</p>

<li><strong>Publication Record:</strong> When we filed the case, our client had published 14 peer-reviewed scientific articles, 3 book chapters, and at least 20 conference presentations.</li>
<li><strong>Citation Evidence: </strong>Using Google Scholar and other references akin to it, we determined that our client’s work had collected 130 citations when we filed the case.</li>
<li><strong>Peer Review Involvement: </strong>Our client had assessed the work of his peers over two dozen times for approximately 10 scientific journals. As journals only invite leading researchers to conduct peer reviews, our client’s outstanding record highlighted the value of his opinions.</li>
<li><strong>Independent and Dependent Support: </strong>We prompted our client to reach out to other experts in his field of biology. We needed him to persuade them to furnish us with strong recommendation letters to bolster our <a href="http://www.wegreened.com/EB1A" title="">EB-1A</a> petition. To our delight, our client returned with six recommendation letters, all of which confirmed the value of his research to the United States; his approaches on early diagnosis and treatment of diseases and disorders, including cancer, diabetes, and inflammation greatly advance the country’s medical sector. One of his recommenders stated that “[<em>Client’s] past achievements, as reflected by his extensive publication and citation record, have been outstanding. It can only be expected that [Client] will continue to be influential in his field and the global community of health science researchers. It is for these reasons that he should be allowed to remain in the United States, where he has access to the best tools to further his research.”</em></li>
</ol>
<p>We are pleased that Nebraska Service Center allowed our client to get significantly closer to his green card. Now all he has to do is file I-485 applications for himself and his dependent(s) and once approved, they will become American permanent residents.</p>

<p>A gifted project manager from Iran hired <a href="http://www.wegreened.com" title="">North America Immigration Law Group</a> (<a href="http://www.wegreened.com" title="">WeGreened.com</a>) to help him sort out the first portion of the green card process: the I-140 petition. After evaluating his credentials, we verified that he was a suitable candidate for <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> (<a href="http://www.wegreened.com/niw/" title="">National Interest Waiver</a>).</p>
