<p>The client that <a href="http://www.wegreened.com">North America Immigration Law Group</a> – <a href="http://www.wegreened.com">WeGreened.com</a> had the opportunity to work with in this case was a Postdoctoral Scholar from Taiwan.  Her work had focused specifically on uncovering details about the mechanisms of biological processes in the human body (like gene regulation), especially as they pertain to cancer and other diseases. We successfully demonstrated that her continued employment in the field would benefit those in her field, as well as the citizens of the United States at large. In order for our client’s case to be successful, we submitted extensive documentation proving her highly significant contributions to her field, including 5 peer-reviewed journal articles and numerous conference papers. Her publications had been cited at least 149 times at the time we filed the case; nearly all of the citations were by independent researchers around the world, demonstrating that these publications are widely recognized and relied upon in the field.  The importance of her work was confirmed in the following quote from an independent recommender, “The fact that [Client] delivered such important findings at such an early point in her career is rather extraordinary.  This demonstrates that she was already quite talented before she completed the rest of her training, giving her a strong edge up on the others in her field.” Through extensive documentation, we were able to successfully argue that our client would serve the national interest to a significantly greater degree than others with similar education and experience. In order for our client’s case to be successful, we submitted extensive documentation proving his highly significant contributions to his field, including at least one textbook, 17 peer-reviewed scientific articles either published or accepted for publication and numerous presentations at national and international conferences; these publications had been cited at least 89 times at the time of case filing by independent and leading researchers from prestigious institutions and organizations around the world, indicating the major significance of his work.  The influence of our client’s work was confirmed in the following quote from an independent recommender, “<em>[His] work on these models represents a major advance in our understanding of nanocomposites using carbon nanostructures. Understanding of these materials is of utmost importance because it enables them to be used to the greatest effect in a wide variety of industries. The numerous uses of nanocomposites is what makes them the focus of so much important research and [his] work is a vital component in making items like medical implants made with nanocomposites more feasible. This is beneficial to researchers outside of [his] field, as well as to patients whose lives depend on these implants. The advantages presented by [his] model have implications not only for his own field, but industries like healthcare, which are concerns of national importance.</em>”  Through extensive documentation, we were able to successfully argue that our client would serve the national interest to a significantly greater degree than others with similar education and experience. His <a href="http://www.wegreened.com/NIW.html#Greencard"><strong><a href="http://www.wegreened.com/niw/" title="">NIW</a></strong></a> petition was approved in just over 1 month.</p>

<p>Yesterday, the U.S. Department of Homeland Security announced that it will publish two proposed rules this week.  One of the rules proposes to extend employment authorization to the dependent spouses of certain H-1B workers.  In a press release dated May 6, 2014, DHS stated, “The change proposed by DHS, would allow H-4 dependent spouses of certain H-1B nonimmigrant workers to request employment authorization, as long as the H-1B worker has already started the process of seeking lawful permanent residence through employment.”</p>
<p>The Notice of Proposed Rulemaking will soon be published in the <em>Federal Register</em>.  DHS will accept public comment on the proposed rules through the following website – www.regulations.gov.</p>
<p><strong>Who Qualifies?</strong></p>
<p>If the proposed rule goes into effect, you will qualify for employment authorization if:</p>
<ul>
<li>You are an H-4 dependent spouse (dependent children will not qualify); and</li>
<li>The principal H-1B worker:</li>
</ul>
<p>o   Is the beneficiary of an approved Form I-140, Immigrant Petition for Alien Worker; or</p>
<p>o   Has been granted an extension of his/her authorized period of stay in the U.S. under the American Competitiveness in the Twenty-First Century Act of 2000 (“AC21”).</p>
<p><strong>How the New Rule Benefits Our Clients</strong></p>
<p>The new rule will benefit our <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> clients on H-1B nonimmigrant status under two circumstances:</p>
<ol>
<li>Clients on H-1B nonimmigrant status from India and China with an approved <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a>
<ul>
<li>Such clients are not eligible to file an I-485 because their I-140 priority date is not current.  However, they are able to extend their H-1B visa status in three-year increments until their priority date is current.  Under the new rule, they will also be able to apply for employment authorization for their H-4 dependent spouse such that their spouse will also be able to work in the U.S. while the family waits for the I-140 priority date to become current.</li>
</ul>
</li>
<li>Clients on H-1B nonimmigrant status from India and China with an <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> I-140 petition pending for more than 365 days at the time they reach the six-year limit for their H-1B
<ul>
<li>Such clients are eligible to extend their H-1B visa status in one-year increments beyond the six-year limit.  Under the new rule, they will also be able to apply for employment authorization for their H-4 dependent spouse such that their spouse will also be able to work in the U.S. while the I-140 petitioner waits for adjudication of his/her <a href="http://www.wegreened.com/niw/" title="">EB-2</a> <a href="http://www.wegreened.com/niw/" title="">NIW</a> petition.</li>
</ul>

<p>The remarkable client that <a href="http://www.wegreened.com/"><b>Chen Immigration Law Associates</b></a> had the pleasure of working with in this case was a Geotechnical Project Engineer from Iran working in the field of geotechnical engineering.  He had conducted research and professional service in a broad spectrum of specialized fields in geotechnical and civil engineering. His work had focused specifically on seismic stability and design procedures for reinforced soil walls and slopes, the response of innovative foundation systems for offshore platform in the energy industry, and offshore geohazards, as well as geotechnical analysis and design of transportation infrastructures and geostructures.  We demonstrated that his continued employment in the field would not only benefit those in his field, but the citizens of the United States at large. To achieve success in this case, we submitted extensive documentation proving our client’s highly significant contributions to the field of geotechnical engineering, including at least 3 peer-reviewed journal articles and numerous conference papers. His publications had been cited at least 106 times at the time of case filing, demonstrating that these publications are widely recognized and relied upon in the field of geotechnical engineering.  Regarding the significance of his accomplishments, one of his independent recommenders commented, “<i>[His] work on understanding the triggering mechanisms of submarine landslides is crucial for the safety of people and industries around the world, so much so that his research was funded by an NSF Career grant.</i>”  Through extensive documentation, we were able to successfully argue that our client would serve the national interest to a significantly greater degree than others with similar education and experience. <p><strong>Case Summary</strong>:</p>
<p>This client was a Medicinal Chemistry expert from India with a fairly strong record of citation.  Even so, this case is a testament to the speed at which Chen Immigration Law Associates can oftentimes get cases approved.  Cases on average require 4-6 months to get approved by the USCIS.  In this particular instance, it only took approximately two months for the client’s petition to be approved.</p>

<p>This client’s research focused on advancing the development of anti-cancer, anti-inflammatory, and anti-viral drug creation.  He also had conducted research on palladium mediated synthetic methods towards the development of Carbon-Carbon and Carbon-Boron bond formation.  The client contributed significant work to his branch of medicinal chemistry by providing patients afflicted with inflammation by studying the use of endogenous lipid mediators and their stable mimetics as a new form of anti-inflammatory agent.   We here at Chen Immigration Law Associates endeavored to prove this client’s value to the national interest by providing documentation of his advancements in Medicinal Chemistry, including 4 of his important publications he has produced concerning his work.  At the time of his petition the client had at least 100 citations to his work, which was indicative of said importance.  To establish his importance to the field, distinguished researchers in the client’s field also provided their input in letters of recommendation.  According to one independent researcher on the client’s importance to national interest: <i>“[Client]’s research pertaining to anti-cancer agents for colorectal cancer is of the utmost importance to the United States. Currently about 100,000 people per year die from colorectal cancer in the United States and about 1 million people across the globe. Many of the drugs that have been developed for treatment of this very serious disease have been aimed at specific mutations or cause serious side effects. Therefore, [client’s]utilization of organic chemistry principles and computational design have provided an important advancement for the field, and his research will allow the medical community the ability to develop new anti-cancer drugs for colorectal cancer in the foreseeable future.</i>”</p>
