Case Summary:
It only took Texas Service Center a month and 18 days to decide that our client’s EB-2 NIW (National Interest Waiver) petition deserved to be approved. This no doubt had to do with the meticulous presentation that our legal team submitted to the USCIS, highlighting our client’s impressive qualifications.
Rules of Cross-Chargeability:
The interesting thing about this case is that despite being born in China and having an EB-2 petition approval, our client can now file an I-485 application (once this is approved, our client will receive a green card). Other Chinese applicants whose EB-2 petitions were recently filed and approved have to wait several years for their priority date to become current before they can file their I-485. This is because the USCIS has a strict quota system in place that limits the number of green cards issued to people born in China with EB-2 approvals. Our client bypasses this step because her spouse was not born in mainland China or India (there is no quota in place for EB-2 applicants born elsewhere). This is known as cross-chargeability.
Although the USCIS only spent a month and a half adjudicating this case, we took far longer preparing the petition.
